A 15-year old boy received a monetary judgment in the amount of about $53,000.00 on claims of wrongful arrest, unnecessary force and constitutionally infirm curfew after he was arrested on Halloween as he left a Walgreen’s store with paid-for bathroom tissue to roll his girlfriend’s cousin’s yard. He was with his girlfriend and her mother was waiting for them in the parking lot. The arresting officer asserted that the boy did not respond when the officer called to him. The second officer transported the boy to the police headquarters. The boy was cuffed behind his back and the officer did not strap him in. The boy asserted the officer would speed up in turns, causing him to be thrown from side to side. He was released to his parents without formal charges after a supervising officer intervened.
